What is a 501(c)4?

A 501(c)(4) is a nonprofit organization operated exclusively to promote social welfare.  Under federal tax law, a 501(c)(4) may engage in any activity that promotes the common good and well-being of the community, whereas a 501(c)(3) organization must engage in only charitable activities.  Therefore, a 501(c)(4) has more flexibility than a 501(c)(3) to focus on improving public policies and government administration.

Can I take a charitable tax deduction for my contribution?

No, contributions to 501(c)(4) organizations are not deductible as charitable contributions for federal income tax purposes. 

 

Will I be subject to federal gift tax on my contribution?

No, contributions to 501(c)(4) organizations are not subject to gift tax.

 

Is there a maximum amount I can give?

No.

 

Are there pay-to-play issues for me or my company if I contribute?

New Jersey’s state and local-level pay-to-play rules are not implicated by donations to a 501(c)(4) organization like Building a Better New Jersey Together, Inc.  Financial services firms and their associates should seek their own legal counsel to determine whether a donation would implicate pay-to-play rules issued by the Securities and Exchange Commission or the Municipal Securities Rulemaking Board.   

 

Will my contribution be disclosed anywhere?

The IRS requires Building a Better New Jersey Together, Inc. to disclose to the IRS the names and addresses of donors who have given donations totaling $5,000 or more per year.  However, this information is not subject to public disclosure, unless any individual involved in managing Building a Better New Jersey Together, Inc. runs for Governor or Lieutenant Governor of New Jersey and seeks public financing for their campaign.  In that event, that individual may be required to disclose donor names and contribution amounts to the New Jersey Election Law Enforcement Commission.

 

What will Building a Better New Jersey Together do with my money? 

Consistent with its Mission Statement, Building a Better New Jersey Together, Inc. will use the funds for research, media outreach and other communications in an effort to help New Jersey work together to solve its most pressing problems.
